SMS Alerts Terms & Conditions

1. Program Description

The ANDBANC Market Alerts program (the “Program”) is a subscription text-messaging service operated by ANDBANC ADVISORY LLC (“ANDBANC,” “we,” “us”). Depending on your plan, messages may include daily market briefings, post-close recaps, watchlists, trade alerts with entry/stop/target levels, position updates, account and billing notifications, and occasional service announcements. Message content is general, impersonal investment information — see the investment disclaimers in our Terms of Service.

2. Opt-In and Consent

• You may enroll only with a mobile number you own or are authorized to use. Enrollment occurs through our online subscription flow, which presents these terms and requires your affirmative consent, followed by a one-time passcode sent to your handset to verify ownership.
• By enrolling, you provide your express prior written consent to receive recurring automated text messages (SMS/MMS) from or on behalf of ANDBANC at the number you provided, including messages sent using an automatic telephone dialing system, as described at the point of opt-in.
• Consent to receive text messages is not a condition of purchasing any goods or services.
• You must be 18 years or older to enroll.

3. Message Frequency

Message frequency varies by plan and market activity. Typical volumes:

During periods of elevated market volatility, alert volume may temporarily exceed these ranges. Account, verification, and customer-care messages are additional.

4. Message and Data Rates

Message and data rates may apply to messages sent by us and to your replies (such as STOP or HELP), depending on your wireless plan. ANDBANC does not charge per message; any carrier charges are your responsibility. Contact your wireless carrier for details about your text-messaging plan.

5. How to Opt Out (STOP)

Opting out of SMS does not cancel your paid subscription or its billing. To cancel your subscription, contact [email protected]; see our Terms of Service (Section 7) for cancellation and refund terms.

6. How to Get Help (HELP)

7. Supported Carriers and Availability

The Program is available on major U.S. wireless carriers (including AT&T, Verizon, and T-Mobile) and most regional carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is outside our control; we do not guarantee message delivery or timing. T-Mobile is not liable for delayed or undelivered messages.

8. Your Responsibilities

• Notify us promptly if your mobile number changes, is reassigned, or is deactivated. You may update your number by emailing [email protected].
• You agree to indemnify us against claims arising from messages sent to a number you provided that was later reassigned, to the extent permitted by law.
• The Program is for personal use; do not forward alerts for commercial redistribution (see our Terms of Service).

9. Privacy

We collect your mobile number, opt-in/consent records, delivery data, and message replies to operate the Program and demonstrate compliance with the Telephone Consumer Protection Act (TCPA) and carrier rules. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for full details.

10. Investment Risk Reminder

Alerts are impersonal investment information, not individualized advice. Investing involves risk, including possible loss of principal; past performance is no guarantee of future results. ANDBANC ADVISORY LLC is an SEC-registered investment adviser (File No. 801-79716; CRD No. 150463); registration does not imply a certain level of skill or training.

11. Changes to the Program or These Terms

We may modify or suspend the Program (including short codes, sender IDs, message formats, or these terms) at any time. Material changes will be posted on this page with an updated “Last Updated” date and, where appropriate, announced by text message. Continued participation after a change constitutes acceptance; if you do not agree, reply STOP to opt out.
